General Terms of Sale (TOS)
Effective as of: JANUARY 2026
ARTICLE 1 - PURPOSE
These General Terms of Sale (TOS) govern the contractual relationship between MAVENS AGENCY (hereinafter "the Publisher") and any natural or legal person (hereinafter "the Client") subscribing to the Mymik application via the mymik.fr website.
ARTICLE 2 - DESCRIPTION OF SERVICES (CRM & Analytics Tool)
The Mymik application is a SaaS software solution designed to optimize the management and tracking of accounts on content platforms. The services include, but are not limited to:
-Real-time tracking of revenue and sales statistics.
-Messaging management tools (CRM) for Chatters.
-Performance tracking for creators and agencies (Analytics).
- Automation of certain profile management tasks.
Access to these services requires the use of a secure API login interface provided by the Publisher.
ARTICLE 3 - PRICING AND PAYMENT
- Price: Prices are listed in euros (excluding or including tax depending on the client's profile) on the showcase site. The Publisher reserves the right to modify its prices at any time, but ongoing subscriptions remain at the price applicable at the time of subscription.
- Payment: Payment is made by credit card via a secure payment provider (Stripe/PayPal).
- Default of Payment: Any failure to pay will result in the immediate suspension of access to the application until the situation is rectified.
ARTICLE 4 - SUBSCRIPTION AND TERMINATION
- Duration: The subscription is offered on a monthly or annual basis depending on the plan chosen by the Client, with a tacit renewal clause (the contract renews automatically).
- Termination: The Client may terminate their subscription at any time from their customer area. The termination will take effect at the end of the current billing period. No pro-rata refunds are issued.
ARTICLE 5 - RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not supplied on a physical medium, the execution of which has begun after the consumer's express prior agreement.
By accessing the Mymik service, the Client expressly waives their right of withdrawal.
ARTICLE 6 - LIABILITY AND USE OF THIRD-PARTY PLATFORMS
- Availability: The Publisher strives to ensure 24/7 service availability, except during maintenance or force majeure events.
- Limitation of Liability: Mymik is a decision-making/management support tool. The Publisher cannot be held liable for the Client's loss of revenue, data, or business results related to the use of the software.
- Compliance with Third-Party Platforms: The Client acknowledges that the use of Mymik takes place on third-party platforms (e.g., OnlyFans, MYM). The Publisher cannot be held liable for any modification of the terms of use of these platforms, technical restrictions, or the suspension of third-party accounts resulting from the Client's use of the tool.
- Client Responsibility: The Client is solely responsible for configuring the tool and how they use it. They agree to comply with applicable privacy laws and the terms of use of the platforms managed via Mymik.
- Model/Chatter Data: The Client is the sole "Data Controller" of the data they import or collect via Mymik (data of their models or employees). The Publisher acts solely as a technical Data Processor.
ARTICLE 7 - OWNERSHIP OF THE APPLICATION
The Client is granted a personal and non-exclusive license to use the software. It is strictly prohibited to copy, modify, decompile, or attempt to extract the source code of the Mymik application.
ARTICLE 8 - PERSONAL DATA
Data processing carried out in the context of the sale is governed by our Privacy Policy available on the site. The Client is solely responsible for the data they import into the application (data of their own clients/models).
ARTICLE 9 - DISPUTES
These TOS are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris.
ARTICLE 10 - CONFIDENTIALITY AND PROTECTION OF COMMUNICATIONS (CHAT)
As a messaging management tool (CRM), Mymik processes sensitive data flows circulating between creators and their subscribers. The protection of this data is governed by the following commitments:
- No Access to Message Content: The Publisher commits to not viewing, using, or exploiting the text content of messages exchanged via the tool for purposes other than strict technical maintenance or the optimization of the application's features (e.g., global statistics).
- Confidentiality of Sales Data: Information relating to financial transactions within the chat (tips, media sales) is processed in encrypted form. The Publisher guarantees that no individual revenue data will be disclosed to third parties.
- Professional Secrecy of Employees: All employees and subcontractors of MAVENS AGENCY with access to technical servers are bound by a strict confidentiality clause and a non-disclosure agreement (NDA).
- Responsibility for Account Access: The Client is solely responsible for managing the access they grant to their own "Chatters" within the Mymik platform. The Publisher cannot be held liable for data leaks resulting from the Client's negligence in managing their credentials or internal permissions.
- Storage Security: Messaging metadata processed by Mymik is stored on secure servers meeting the highest security standards in the SaaS industry.
