Affiliate Terms and Conditions

The MYMIK affiliate program allows independent partners (hereinafter "the Affiliate") to earn compensation for referring new agency clients (hereinafter "the Referred Client"). The Affiliate acts as an independent entity and is in no way an employee, agent, or legal representative of MYMIK.

- Rate: 15% of the pre-tax amount (excluding VAT) of the subscription purchased by the Referred Client.

- Duration: The commission is paid on each monthly installment paid by the Referred Client for a maximum period of 12 consecutive months from their registration date.

- Eligibility: Only activated paid subscriptions (excluding free trial periods) qualify for a commission.

- Waiting period: In order to prevent fraud and refund requests (chargebacks), commissions are validated 30 days after the actual payment by the Referred Client.

- Payment threshold: Earnings can be withdrawn as soon as the validated balance reaches €50.

- Method: Payments are made via bank transfer. The Affiliate is solely responsible for declaring their income and paying any applicable taxes in their jurisdiction.

MYMIK reserves the right to suspend an affiliate account and cancel pending commissions without notice in the event of:

- Self-referral: Subscription by the Affiliate using their own link for their own agency.

- Brand Bidding: Purchasing keywords on search engines (Google Ads, Bing) that include the term "MYMIK" or close spelling variations.

- Spamming: Sending unsolicited messages, promoting on illegal sites, or deceiving others regarding the nature of the offer.

- Brand usage: Using MYMIK logos or visuals without respecting the brand guidelines or in a way that misleads the client as to the identity of the company.

- False Advertising: Any promise of guaranteed income or unrealistic results through the use of MYMIK to attract referrals is strictly prohibited.

- Impersonation (Parasitism): Creating social media accounts using the name "MYMIK" to impersonate official support or the official brand page.

In the event of a refund (chargeback) or fraudulent cancellation of a transaction after the commission has been paid, MYMIK reserves the right to deduct the undue commission amount from the Affiliate's future payments.

The program uses the "Last Click" system. The affiliate cookie has a lifespan of 30 days. If the prospect does not complete their registration within this timeframe or subsequently uses another affiliate link, the commission cannot be attributed.
The attribution of the commission relies exclusively on affiliate link tracking. If the User blocks cookies or uses a browser that prevents tracking, MYMIK cannot be held liable for the non-attribution of a sale.

MYMIK reserves the right to modify the program terms or terminate it at any time, provided affiliates are informed with reasonable notice. Commissions validated prior to the modification will remain due under the original terms.

These Terms are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris.

As a messaging management tool (CRM), Mymik processes sensitive data flows circulating between creators and their subscribers. The protection of this data is governed by the following commitments:

- No Access to Message Content: The Publisher commits to not viewing, using, or exploiting the text content of messages exchanged via the tool for purposes other than strict technical maintenance or the optimization of the application's features (e.g., global statistics).

- Confidentiality of Sales Data: Information relating to financial transactions within the chat (tips, media sales) is processed in encrypted form. The Publisher guarantees that no individual revenue data will be disclosed to third parties.

- Professional Secrecy of Employees: All employees and subcontractors of MAVENS AGENCY with access to technical servers are bound by a strict confidentiality clause and a non-disclosure agreement (NDA).

- Responsibility for Account Access: The Client is solely responsible for managing the access they grant to their own "Chatters" within the Mymik platform. The Publisher cannot be held liable for data leaks resulting from the Client's negligence in managing their credentials or internal permissions.

- Storage Security: Messaging metadata processed by Mymik is stored on secure servers meeting the highest security standards in the SaaS industry.
